General Terms and Conditions
The General Terms and Conditions of the online store Cvetličarna Omers (cvetlicarnaomers.si) define the rules and procedures for purchasing through the online store. We kindly ask you to read them carefully before using our services, as they are binding for both the provider and the users (customers). By placing an order, you express your agreement with these terms and confirm that you are familiar with them. If you do not agree with the terms, we kindly ask you not to use the online store.
The General Terms and Conditions are compiled in accordance with the Slovenian Consumer Protection Act (ZVPot), the Electronic Commerce Market Act (ZEPT), the Obligations Code (OZ), the Personal Data Protection Act (ZVOP-2), the General Data Protection Regulation (GDPR), the Electronic Communications Act (ZEKom-2), the Trade Act (ZT), the recommendations of the Slovenian Chamber of Commerce (GZS), and international e-commerce codes.
1. Provider and Availability of Information

The provider undertakes to provide customers with the following information:
- Company identity (name, registered office, registration, and tax number).
- Contact details (email).
- Essential characteristics of products and services.
- Availability of products (stock status).
- Delivery conditions (method, location, time, and costs).
- Clearly stated prices, including VAT and delivery costs.
- Payment methods.
- Time validity of the offer.
- Conditions and deadlines for withdrawal from the contract, including return costs.
- Complaint handling procedure and contact for complaints.
The provider reserves the right to amend the terms and conditions without prior notice. Updated terms are published on the website and are effective from the date of publication.
2. Purchasing in the Online Store
2.1. Purchase as a Guest or Registered User
You can make a purchase as a guest or a registered user. Registration allows for easier order tracking and access to potential discounts for loyal customers. To register, you must provide personal information (first name, last name, address, email address, phone number) necessary for order processing and delivery. After registration, you will receive a username and password via email.
By placing an order, you enter into a sales contract, which is stored electronically on the provider’s server and is available upon request.
2.2. Purchase Process
The purchase process includes the following steps:
- Search and select a product in the online store.
- Add the product to the cart (click the “Add to Cart” button).
- Select the quantity of the product in the cart.
- Review the cart with calculated costs.
- Click the “Proceed to Checkout” button to continue.
- Enter account details (as a guest or registered user).
- Enter the delivery address.
- Select the delivery date.
- Choose the payment method.
- Confirm the order and complete the purchase.
After placing an order, you will receive an email notification confirming that the order has been received and is pending. You may cancel the order within 30 minutes of submission via email or phone. If the order is not canceled, the provider reviews the availability of the products and either confirms or rejects the order with a justified reason (e.g., unavailability of flowers). The order is finalized upon payment, marking the conclusion of an irrevocable sales contract.
When the order is ready for delivery or pickup, we will notify you via email or phone. The notification includes information about the withdrawal policy, contact details in case of delivery delays, and a contact for complaints.
For orders exceeding 100 EUR, cancellation is possible only under exceptional circumstances if the product has not yet been made, and must be requested at least 22 hours before the agreed delivery time via email or phone.
3. Payment Methods
We offer the following payment methods:
- Bank Transfer (UPN): Payment to the provider’s business account via bank, post office, or online banking. After payment, please send proof of payment to info@cvetlicarnaomers.si; otherwise, the procurement and delivery process will not be initiated.
- Credit/Debit Card Payment: We accept payments with Visa, Mastercard, and Maestro cards.
- PayPal Payment: Using the PayPal payment system.
- Payment upon Pickup: Cash or card payment upon personal pickup at the main store (Ljubljanska cesta 72, 1230 Domžale).
Payment must be completed before delivery, except in the case of personal pickup.
4. Prices and Discounts
All prices are in euros (€) and include VAT (9.5% or 22%, depending on the statutory tax rate of the product). Prices are valid at the time of placing the order and do not have a predetermined validity period. Delivery costs are not included in the product price and are clearly indicated before order confirmation.
The sales contract is concluded when the provider confirms the order (email notification “Order Confirmed”). From that moment, the prices and conditions are fixed for both parties. The customer is responsible for verifying the accuracy of the invoice data; subsequent complaints will not be considered.
If a price is incorrectly listed or changes during order processing, the provider will notify the customer and allow them to withdraw from the purchase or replace the product.
The provider may offer discounts or promotional codes as part of promotional campaigns, valid for a specific period as stated in the campaign terms. Discounts and promotional codes generally cannot be combined unless explicitly stated otherwise.
5. Delivery
5.1. General Provisions
Delivery is carried out to the agreed address and time selected during the order process. Delivery is considered a single visit to the address. We deliver throughout Slovenia in cooperation with delivery services (e.g., Pošta Slovenije, GLS). The provider reserves the right to choose an alternative delivery service if it is more efficient.
Delivery is available Monday to Friday from 7:00 AM to 6:00 PM and on Saturdays from 8:00 AM to 1:00 PM. Deliveries are not made on Sundays or public holidays. Delivery is executed after payment confirmation.
5.2. Delivery of Bouquets, Potted Plants, and Gifts
For delivery between 7:00 AM and 3:00 PM, the order and payment must be submitted:
- By 4:00 PM on the previous working day before delivery.
- By 11:00 AM on Saturday for delivery on Monday.
For urgent delivery after 3:00 PM, the order and payment must be submitted by 10:00 AM on the day of delivery, subject to available capacity. For exceptions, please arrange by phone.
For deliveries before holidays or special occasions (e.g., Valentine’s Day, Women’s Day, All Saints’ Day), we recommend placing and paying for the order a few days in advance.
Delivery fees based on distance:
- Zone 1 (up to 3.0 km from Domžale): 5.00 EUR.
- Zone 2 (3.0 km to 10.0 km): 7.00 EUR.
- Zone 3 (10.0 km to 15.0 km): 10.00 EUR.
- Zone 4 (15.0 km to 30.0 km): 12.00 EUR.
- Zone 5 (30.0 km to 100.0 km): 15.00 EUR.
For distances exceeding 100.0 km, the delivery fee is agreed upon individually. There is no minimum order value.
5.3. Delivery of Funeral Products
For the delivery of funeral products, we recommend placing and paying for the order three days before the funeral. In exceptional cases, the order can be placed:
- At least one day before the funeral for Ljubljana and its surroundings.
- At least two days before the funeral for the rest of Slovenia.
For deliveries before holidays or special occasions (e.g., All Saints’ Day), we recommend placing the order early.
Delivery fees for funeral products are the same as for bouquets, potted plants, and gifts (see above). For orders over 150 EUR, delivery is free of charge.
5.4. Unsuccessful Delivery
If the recipient is not available at the agreed address at the agreed time or if the provided information is incorrect, the delivery is considered unsuccessful. We will notify the customer and/or recipient about this. The customer is responsible for providing accurate information, including the recipient’s phone number, as the delivery service may contact the recipient to ensure successful delivery.
In the case of an unsuccessful delivery, the product may be delivered to the nearest alternative location (e.g., a neighbor, reception) or to a location specified by the customer in the “Delivery Comment” field. A notification will be left in the mailbox. If the product is not picked up on the same day, the customer forfeits the right to claim compensation for wilted flowers.
5.5. Force Majeure and Limitations
In the event of force majeure (e.g., natural disasters, traffic disruptions) or other reasons preventing delivery within the agreed timeframe (e.g., unavailability of specific flowers), we will inform you and arrange an alternative time, product, or delivery method. The provider reserves the right to withdraw from the contract if certain flowers cannot be sourced, and will notify the customer accordingly.
6. Right of Withdrawal
In accordance with the Slovenian Consumer Protection Act (ZVPot, Articles 43.č–43.e), you have the right to withdraw from the contract within 14 days of receiving the products without stating a reason. To withdraw, notify us in writing via email (info@cvetlicarnaomers.si) or by mail to: Strehar Apolonija s.p., Ljubljanska cesta 72, 1230 Domžale, Slovenia.
You must return the products within 14 days of notifying us of your withdrawal to the above address. Returned products must be undamaged, in their original packaging, and in the same quantity, unless they were damaged or lost through no fault of your own. The cost of returning the products is borne by the customer, unless otherwise agreed.
We will refund the payment (including delivery costs, if applicable) within 14 days of receiving the returned products, using the same payment method as the original transaction, unless otherwise agreed.
Exception: The right of withdrawal does not apply to perishable products (e.g., fresh flowers, bouquets) or custom-made products (e.g., personalized arrangements, funeral products), as per Article 43.č of the ZVPot. Cancellation of orders for such products is not possible after confirmation, as the procurement and production process begins immediately, which may cause financial loss to the provider.
7. Warranties and Complaints
If a product is damaged, defective, or does not match the order (e.g., wrong product, delivery to the wrong address, inability to receive due to the provider’s error), you may file a complaint in accordance with the ZVPot. Submit the complaint immediately upon receipt or within 8 days of receipt via email (info@cvetlicarnaomers.si) or by phone. Please attach photos of the damaged product and a description of the issue.
The provider will review the complaint as soon as possible (within 8 days at the latest) and offer a replacement, repair, or refund, depending on the nature of the issue. Complaints regarding wilted flowers are not accepted if the product is not picked up on the day of delivery or if the issue is not reported immediately upon receipt. For potted plants and durable products, a statutory warranty for material defects applies (2 years from receipt, as per Article 37 of the ZVPot).
If the product is in transit for more than 48 hours, its aesthetic lifespan may be shortened, which is not grounds for a complaint unless the fault is due to the provider.
8. Product Variations
Product images on the website are symbolic. The final product may vary in flower color shades, and flowers that are currently unavailable may be replaced with similar ones. However, the product must not deviate from its description in terms of purpose, shape, size, quality, number of flowers, or value. The provider strives to ensure the final product closely matches the desired item.
9. Added Decorative Vase
If a decorative vase is ordered, the provider will include a vase that matches the chosen flowers. Vases may vary, and the customer will not be informed of the specific vase selection in advance. Complaints regarding the choice of vase are not accepted.
10. Added Dedication
When placing an order, the customer may add a dedication (limited to 100 characters), which will be printed on a card. The dedication will be transcribed verbatim, and the layout and print design are standard and cannot be modified.
11. Data Protection
The provider processes personal data in accordance with the Personal Data Protection Act (ZVOP-2) and the GDPR. Details regarding the collection, processing, and protection of data are provided in the Privacy and Cookie Policy.
Promotional emails will be clearly marked as such, with the sender clearly identified. Campaign and promotion terms will be clearly stated, along with the option to unsubscribe from promotional messages upon the customer’s request.
12. Complaints and Dispute Resolution
The provider is committed to resolving complaints quickly and fairly. Submit complaints to info@cvetlicarnaomers.si. The complaint handling process is confidential, and we will respond as soon as possible, within 8 days at the latest.
In accordance with the ZVPot (Article 32), consumers may resolve disputes via the Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr. The provider does not recognize any out-of-court dispute resolution provider as competent for resolving disputes.

The content on the website (images, texts, logos) is the property of Cvetličarna Omers or its partners and is protected under the Copyright and Related Rights Act. Unauthorized use, reproduction, or distribution is prohibited.
